An annulment is called a decree of nullity in the Church. It doesn't annul a marriage, it is a declaration that no marriage ever existed. If you are in a valid marriage, then no force on earth can annul it. To apply for a decree of nullity, you start by talking with your parish priest. He will give you the forms and explain what is involved in the process. When all of the research is done, it gets send to the Marriage Tribunal in your diocese, which will issue a ruling. IF the Tribunal issues a Decree of Nullity, it automatically gets appealed to Rome where they will look it over and decide if it is valid or not.

There several reasons a marriage can be annulled.

1 a person is impotent and incapable of consummating a marriage

2 one person is already legally married

3 a person is mentally incapable of understanding what is happening, be it intoxication or mental illness

4 a person was forced to marry under duress, via threats.

5 there is a close blood relation between those that got married

6 one was too young to get married

Any of these cases a grounds for a annulment in the Catholic faith. However the Church does not take lightly annulling a marriage as they believe it a loving bond meant to be for life. You have to petition the Church and they will look at the marriage and access if one or both parties had entered the marriage with good will, but lacked the openness, honesty, maturity, fully free choice, right motivation, emotional stability, or capacity to establish a community of life and love with another person. Even when they view the marriage they will probably want both people to enter counseling first. If they find that everything meets the right for an annulment then one will be granted and you will be free to marry in a church again.

Civil annulments are available in family court if the requirements are met and a divorce procedure is not necessary in order to dissolve the marriage legally. When an annulment is allowed it extinguishes the marriage as though it had never happened.

Grounds for a civil (and ecclesiastical) annulment vary but can include the following:

  • lack of legal capacity
  • force or threat
  • under age of consent
  • consanguinity- too closely related
  • impotency not disclosed before marriage
  • fraud
  • marriage never consummated
  • duress, insanity
  • being under the influence of alcohol or drugs

You need to check the laws in your particular state. Laws regarding civil annulment vary from state to state. Some states do not allow annulment if there are children born of the marriage. That makes sense because the couple can dissolve the marriage by a divorce proceeding. Every state has statutory reasons why a court can declare a marriage null and void. The court in states that allow civil annulment with children may look more closely at those reasons if there were children born of the marriage since declaring a marriage null and void may have some emotional or social effect on the children. If there are children involved, the annulment does not make them "illegitimate" and the court will issue custody and child support orders.

Can Catholic Church annul Episcopal wedding?

Yes. The Catholic Church can "annul" any marriage. The marriage must first be presented to the marriage tribunal through your local diocese. After the tribunal concludes their investigation and, having found sufficient evidence that the marriage was indeed invalid, a "Decree of Nullity" will be issued. This process can be lengthy and sometimes expensive.

Can the Catholic Tribunal annul a blessed marriage that was first a civil marriage?

A civil marriage union that has never at any time been re-avowed in the Rites of the Catholic Church before an ordained Catholic priest would not be a marriage recognised by the Catholic Church. It would be considered a marriage 'outside' of the Church. Therefore it is unlikely that the Catholic Tribunal would see any requirement to apply for a Papal Dispensation to annul the marriage, because in the eyes of the Church there would be no marriage to annul. If the civil union, were later properly re-avowed in the Catholic Rite before an ordained Catholic priest, then any previous ceremonies are irrelevant to the Church and the Church would recognise the marriage. In that case an application to His Holiness, The Pope, could be made by the Tribunal on the couple's behalf, to annul their marriage. Not every application is successful.Whatever the position with the Church, a Decree Nisi Absolute (a civil divorce) would need to be obtained to legally and lawfully annul the marriage in civil law and this will not affect or change the position of the Church.Catholic AnswerUpon reading your question, it seems that you are using the term "blessed" to mean that the couple got married in front of a priest AFTER they had already been married in a civil ceremony. If the couple subsequently sought to have the marriage annulled, they would have to apply to the Tribunal. A Tribunal can only declare an invalid marriage null, they cannot annul a valid marriage. So the couple would have to prove that no valid marriage ever took place.

The English Reformation occurred in the 16th century when King Henry VIII wanted to annul his marriage to Catherine of Aragon to marry Anne Boleyn.
