I'm pretty sure if your boyfriend is going to jail it wouldn't really help or make any difference if you break up with him.
If you want to breakup, just tell him that you don't want to be with him anymore and that you think it's time you ended it.
Note:
If this question is implying that the age difference is a legal issue (statutory rape) breaking up with him will only prevent future counts being added to the list of charges. Breaking up will not mitigate charges reflecting actions the two of you have already taken.

∙ 13y ago- Your boyfriend is psychologically holding you prisoner. He's bluffing because he would have to prove mental abuse. Try putting a recorder under the couch or somewhere he will not see it for a day or two and get his threats on tape. Then leave and report it to the police or at least see a lawyer if at all possible so there is a record of it. Be sure and keep a copy of the tape for yourself. There is not much he can do to you once you leave and a mental abuser seldom wants to leave when they supposedly have their victim (your boyfriend) trapped so accusations would not hold water.

I do not know if what your boyfriend is doing would be considered mental abuse, but to me he is being insensitive and rude at best. What does it matter what the label is? If your boyfriend is treating you disrespectfully, and this certainly sounds disrespectful to me, the very least you need to do is to sit down with him and explain that you do not like to be talked to like you are a child. If that doesn't change things, I would seriously consider if it would be best for my personal future to break up with him.
