If the parties were legally married you must obtain a legal divorce in your state family court system. You should visit the court and speak with a clerk. You will be allowed to file a complaint for divorce even if you don't have your spouse's current address. In that situation the courts will allow notice by a publishing in the local newspaper.

How can an American same-sex couple who married in Canada obtain a divorce?

The partner(s) who wishes to be divorced must find a jurisdiction in which: (a) the same-sex marriage is recognized; and, (b) the partner meets the residency requirement. For example, if the married couple lives in New York State, they can get a divorce in New York State, the same as an opposite-sex couple. If the married couple lives in Texas, at least one partner will need to move to a state where the marriage is legally recognized, live there for the minimum amount of time required by that state's divorce statute (for example, one year), then file for divorce in the new state. After that, the actual procedure is the same as for opposite-sex couples.

Can you become a domestic partner if your divorce is not finalized?

No. You must wait until your divorce is finalized. The only exception might be if you are applying for domestic partnership in a state where same-sex marriage is not legally recognized and your prior marriage was to someone of the same-sex and therefore void.

How does a same-sex married couple obtain a divorce in California?

At least one spouse must have lived in Canada for a minimum of one year before filing for divorce. The process is the same as for any other divorce. One partner files a petition in court and follows the prescribed procedure until a judge signs a divorce decree. The process can include hearings and settlement conferences. It is simpler if there are no children and no real estate.

Officially Belarus might be a republic but in reality the government is in a form of dictatorship. That is because Belarus had the same president since 1994, and no branch of government in Belarus was not able and will not be able to dismiss him in near future.

To the extent that a Vermont civil union is recognized as a marriage under Maryland state law, if you meet all the requirements for divorce (residency, etc.), the state of Maryland will grant you a divorce from your same-sex partner in a civil union and that divorce will be recognized in Vermont as well.
