You have to prove in a court of law that the other parent is unfit. If the other parent is into drugs, alcohol, living like a gypsy or refusing to work and lives in a bad environment, then your chances of sole custody are great. It's best to see a lawyer and if you can't afford a lawyer and worry about the endangerment of your child(ren) then you can go to Child Welfare. Child Welfare will investigate the situation and report it to the courts. Marcy

File a petition to have the current custodial order amended to sole custody or file a new petition for sole custodial rights. Please be advised that judges are very reluctant to grant sole custody except in cases where it has been proven that a parent is neglectful or abusive or the child's welfare is otherwise being jeopardized.

It is possible, however it depends on the circumstances. There would have to be a full investigation, followed by an order of the court. It is not an easy thing to do, unless the circumstances are extreme, at least in most cases.

If there was a previous court order giving the other parent custody, but the children are now living with the non-custodial parent, then yes. You should petition the court to change the custody order to reflect the new living arrangements.
