I am a plaintiff in a Small Claims Court case in Lakeland, Florida. The judge decided against me even though the only evidence was in my favor. I was told to file a motion to reconsider the verdict. What do you say? I do not know anything about motions.
No. Criminal mischief is a crime (as far as i know its a misdemeanor, but it could be a felony somewhere). Being that it is a crime it goes to a criminal court. Small claims court is for civil disputes, typically for claims under $2,000. Only your state/county/local law enforcement can take someone to court for criminal mischief. Now say the 'criminal mischief' was something that caused damage to you or your property, then you can file a suit in small claims court for the cost of damages. You just need to be able to prove what it cost(s) to fix these losses.

From what I know you can't sue for emotional distress in small claims court period. However, you can request pain & suffering along with the medical bills you want paid.
I live in Maryland and the person I would like to sue lives in Virginia can I file in Maryland?
I don't know why you would not be interested in small claims court. There are no other options except mediation, which only works if both parties are willing to participate.

Good luck and God Bless:) The injured party can file suit in the appropriate state court in the county in which the person at fault resides. The best choice would be small claims court as the filing fees and procedures are fairly simple, this is assuming you are suing the individual and not his insurance provider. Contact the office of the clerk of the small claims court for specific information.
I do not know how well it will work for you but for me a small file can be wormed into the cracks and used to take apart the clip
