You have a choice about pressing a case following an accident. Many would recommend an attorney, and this is a good idea. But there is a mechanism within the legal system that allows you to press your own case. If you elect to go down this path, you will absolutely have to educate yourself in legal issues. You will be acting pro per and representing yourself. And the possibly exists that you will eventually have to appear in court and face an attorney that the defendant might hire. You'll be filing an action in civil court, and you'll have to know how to write that complaint. There are codes of civil proceedings that you will have to read. And there are supporting documents that you'll have to gather. There is no way to lay out a civil claim here. It would take far too much room, and is inappropriate for this forum to tackle it. Weigh your options, gather your documentation and write a list of facts concerning the case. Leave all your anger, resentment and frustration out of your notes. Then at least get a consultation with a legal professional. It will be modestly priced or even free, and this is because most lawyers will invest a little time in a prospective client to assess the merits of the case. You can understand why, too, when you consider that the individual you consult will want to see if a case can be made, if it has a "good" chance of being won or settled, and some money earned. Note that if you have a "good" case and it is well presented, a settlement might allow both you and the other party to come away without either party being shredded in the process. And, very importantly, it will avoid a showdown in open court, with its associated costs and hazards. Aside from a wish for good luck in resolving this, you are reminded that it is imperative that you think things through and at least get some consultation.
You can sue in most jurisdictions
WEL IF ANYONE SCRATCHES OR DENT YOUR CAR THEN YOU CAN SUE
the question is, how did you acquire your accident? if you believe that the accident was caused by someone else negligence or of a faulty machinery, yes! you can sue your employer and can file for an accident at work claims.
If you caused the crash, you can't sue anybody and win. You will obviously lose- you caused the accident. If you were hit by the car and were doing everything right, then sue the person who hit you.
