The petition including the required substantiating documentation must be filed in person by the requesting minor. All fees and court costs are to be paid by said minor at the time of the petition filing. If the minor is at least 16-years of age and lives in a state that allows emancipation, he or she may file a petition in the circuit court in the county or city of residence. In my 25 years of practicing law I have only witnessed the granting of two emancipation decrees, with both minors being in unusual circumstances pertaining to inheritances, and in both the court appointed a conservator to oversee the minor's financial affairs.
