Unless you go through a process of getting a Certificate of Rehabilitation through the Superior Court of your area (this requires being a good honest citizen for several years--see site below) or you successfully make a Direct Appeal for Pardon to the Governor--you NEVER get your right to own a gun back

Start by hiring an attorney that is a member of the MN bar. You will need them to file a petition with the courts for restoration of firearm rights. This must have been for a STATE conviction, and not a Federal, and you must be discharged from the sentence you rec'd (including parole). This is the MN statute:

609.165 Subd. 1d.Judicial restoration of ability to possess firearms and ammunition by felon. A person prohibited by state law from shipping, transporting, possessing, or receiving a firearm or ammunition because of a conviction or a delinquency adjudication for committing a crime of violence may petition a court to restore the person's ability to possess, receive, ship, or transport firearms and otherwise deal with firearms and ammunition. The court may grant the relief sought if the person shows good cause to do so and the person has been released from physical confinement.If a petition is denied, the person may not file another petition until three years have elapsed without the permission of the court.

Start by hiring an attorney- you will need one. You will need a pardon by the governor.You must apply directly to the governor for a pardon if:

  • you live outside California, or
  • you were convicted of certain misdemeanor sex offenses.
Otherwise, obtaining a pardon is a two-step process:
  1. Petition the superior court for a California Certificate of Rehabilitation.
  2. If the petition is granted, it automatically becomes a petition for a pardon from the California Governor.
California's governor has complete discretion to grant or deny pardon requests. Generally, applicants must have resided for a minimum of seven years in California. They must also have had no criminal involvement for at least 10 years.
