Check the petal and make sure that the plastic part that touches the brake light switch when the petal is in contact with the brake light switch is still on the petal, if it is missing you will need to replace it, so the petal will make correct contact with the brake light switch.
The manual running light switch may be "on". It is located on top of the steering column, near the dashboard guages, in a 1998 Legacy. The switch operates the lights without requiring the ignition switch to be on.
The rear lights of your car will still on even if your car was off because the switch was turned on and it will still remain on until the battery's out. There might be a switch attached to the brake pedal. When depressing the brake, at a certain point in the travel of that pedal, it trips a switch, which turns on the brake lights. Assuming you mean brake lights, the brake light switch is broken or out of adjustment.
Sounds as if it is out of alignment, like someone is still steping on the brakes as you leave the vehicle. Or if some rewiring was redone, recheck it. Or your light switch is not working properly.
