Although the supreme court is only suppose to interpret the law the have become a law making body. When they make laws they can be ignored for they have usurped the legislative power. The states for instance have alone the authority to issue marriage licenses. If one state decides to issue licenses to only men and women that is their sole perogative and is not the business of the courts or congress. If other states do diffferently then that is their perogative. If congress deems granting marriage licenses to gays is not in the interest of the common welfare then they can step in. States can do this as well. The states are totally free to determine the drinking age of its citizens. If congress sets up a universal age then they must have good reason but it doesn't come under the supremacy clause. This goes for smoking as well. The big question is who determines what is unconstitutional. The states can certainly declare a law of congress unconstitutional because they have the power to do so and the intelligence to do so using right reasoning. The states primary responsibility is to protect its citizens and their common good and interests. And if it is the only one out of the 50 states to see it this way then so be it. If laws are not made in pursance of the constitution then they are unconstitutuinal and are to be ignored by the powers that be and hopefully that isn't some state court that blindly follows other courts. Judges in state courts have sworn to uphold the constitution and should know it backwards and forwards.
