Impossible to answer this question without knowing more about the actual offense. New Jersey is known for having some of the toughest gun laws in the US, and a judge may well sentence you to jail time, first time, or not.

I do not believe that there is ANY place in the US where you can be held in jail without ANY charges being placed. If this actually DID occur and it can be proven, you should sue the agency that jailed you.

At least in the US, if they can't prove it you won't go to jail for the crime. You may be arrested and held for trial, but not for the crime itself.
