That varies by state, and to some degree, local judges. In Massachusetts, the bank must now give tenants 90 days notice. After the 90 days, the bank can file an eviction case, which takes three weeks to get to court. At trial, the banks usually offer 45 days, and judges usually allow the tenant 60 days. This is all Massachusetts, but states are fairly close in this.
