It varies between states, it can be 6 months-1 year but also depends on what reason he has for being absent and if he has paid child support and if not, the reasons for that. Taking away parental rights are not taken lightly.

How many months behind in child support can you be before your rights are taken away?

none as they are separate issues and most child support arrears are on men who learned years later that they were a father, when ordered to pay back to the birth of the child.

Do you have to file for custody of your child in order to get a court document stating you have sole custody?

No. If the other parent has not had his/her parental rights taken away by the court, he/she is still responsible for providing financial support for the child(ren).

If a mother gets her child taken from drug abuse. What rights does the father have if he does not live with her and no custody is court ordered?

Even with a custody award, if the child is in state care, his chances are 15% in getting the child. see links below

If you died would your son be taken away from his step father and step brother and returned to his biological father seeing as legally he is not my husband's baby or does marriage bring rights?

Marriage by itself does not bring custody rights to non-biological children. Where the children go when the biological mother dies depends on who has custody, whether the non-biological father has adopted the child, whether the biological father wants the child, and on the laws of the state where all of this is happening.

What is the procedure for your husband to adopt your unborn child from a previous relationship?

It can be very complicated depending upon the laws of the state in which the couple reside and whether or not the biological father disagrees with the adoption. If the child is a result of an affair during the marriage, the court rarely intervenes if the husband accepts the child as his own, even if the biological father files for parental rights. If the child was conceived out of a relationship before the woman married, then no action can be taken until the child is born, parentage is established and the biological father voluntarily relinquishes his parental rights. If the biological father forfeits his rights to the child, the couple can petition the court for the husband to legally adopt said child. A biological parent CANNOT be forced to give up his parental rights to a child except by a court when it pertains to matters of abuse, neglect, etc. Please be advised, this is the basic legal procedure, exact information pertaining to the issue should be obtained from an attorney licensed to practice family law in the state where the couple reside.

Can a non biological father adopt a child he is raising?

It all depends on what is his status. For example-if the NBF was married to the mother before a child was born he is presumed to be the father and there is no need to adopt the child. In the other hand if there is a bio-father it is required to ask him to relinquish his rights.

When the father of a child is a minor can his parental rights be taken away and if so how is this done?

No, you really can't. But you can go to the hall of justice and get full custody of your child. * The biological father of a child who is not of a marriage has no legal rights to the child until paternity is established and a petition for custodial or visitation rights are granted by the court.

Can a man sign over rights to get out of paying child support?

Signing rights away will not stop any child support from being taken from the father. If the child is the fathers then he is financially responsible for the child weather he has rights or not.

Can you file a missing person report on your child if the father will not contact you?

No, not if you know where the child is (because then it is not missing is it!). If the father has taken the child or you are not getting your contact rights then you should consult an attorney (lawyer) and get a Court order.

Should a custodial mother file a child support modification when her child was legally adopted?

Who legally adopted the child? If the mother's new husband legally adopted the child, then the biological father's parental rights had to be terminated first. Which means that the biological father is NOT obligated to pay child support anymore. The new adoptive father has taken on all rights and responsibilities for the child.

Can father have rights to child's medical record if the parents are not legally married but father did signed VAP?

As long as the father has not voluntarily relinquished his parenting rights, or they have not been taken from his by a court, he should have full access to medical records.

Is a father relieved of his financial obligations if he signs his rights away and the child is adopted by someone else?

Yes, the courts want to see that a father has taken finical responsibility for a child and if the biological father has forfeited his rights through adoption, the adoptive father is now the responsible party, NOT the biological father through the eyes of the court.

Can the mother of a 2 month old baby keep the father from seeing the child if they have never been married when the father wants to support and help with care?

nope. if the father is indeed the biological father then he has rights that can not be taken away unless he willingly gives it up by sighning off his rights or it is cort ordered. but in no way can the mother of a child regardless of the age of the child keep the father from seeing his son/and of daughter.

How can you know if a child has been taken away from her mother if the mother does not want to tell the father of the child or the father's family?

One would assume the father has access rights and would figure out the child no longer resides with the mother. He will be notified that the child support will be going to a different receiver. see links below
