I work at a restaurant and can be on my feet nonstop for hours on end, like 4 or 5, and when I sit down for a second because my back or feet need a rest I get yelled at. I can work all day, eat on the go while standing and finish my shift of over 8 hours on the average and never be allowed to sit. Is this legal?

If you are in the United States, then your employer is required to pay for your meal break only when you do not have the opportunity to take it away from your work station, or if you are called back to your duty while on your meal break. You receive a 15 minute break for every four hours you work, and a 30 minute meal break for every six hours you work.

legislation states that a person is entitled to a 20 minute break every 4 hours. However, some employers may offer this in different ways. For example, An hour break after 5 hours of work
