States extradite from other states, not cities and counties. Once the procedure has been set in motion there is no statutory time limit on the process. It takes as long as it takes and it is not an immediate thing. Due to the necessary legal requirement of the procedure it takes longer than 24-48 hours. If you are held awating extradition for more than 90 days file a writ of Habeus Corpus.

What is a sentence for waive?

The criminal decided to waive an extradition hearing, and was flown back to Kansas. During wartime, armies will often waive some of the physical requirements for enlistment.

How long does it take Florida to extradite?

It takes as long as the process takes. If the detainee waived extradition it could be done relatively quickly. If he didn't waive, it will take as long as the playing out of the legal process and paperwork takes.

Will the arresting state notify person of the charge for extradition?

Yes. Under US law you must be advised of the reason for your incarceration. You will be brought before a judicial officer and advised of the charges and the reason for your incarceration - if the extraditing state is coming for you - and whether or not you wish to waive formal extradition.

What is extradition and how does this policy work?

'Extradition' is a term describing the legal process by which a wanted individual is removed from the apprehending jurisdiction to face legal action for offenses he committed in another jurisdiction. (i.e.- you commit an offense in Texas but are arrested by Oklahoma - you are held in custody in Oklahoma until you either 'waive extradition' and voluntarily agree to return to Texas, or are held until Texas files extradition proceedings against you in Oklahoma's court system.)

What happens if you waive your right to an extradition trial?

You would basically be agreeing to voluntarily go to the state that is charging you. You would let them pick you up or perhaps you can drive to the state to surrender.

How long can someone be held after sentence for extradition from Florida to Massachusetts?

If the person being held does not "waive" extradition it will take some timebecause the detaining state has to hold an extradition hearing to satisfy their law that the extradition is being done 'legally.' There ARE legal procedures that must be followed and adhered to (i.e.- filing of papers - court hearing - arranging transportation, etc, etc) A 'reasonable' length of time by the jurisdiction issuing the warrant is expected. However it will seldom be as short as 24 hours, or even a week, but it should not take up to months either. If the delay seems unreasonably long a writ demanding action, or release can be filed with the detaining jurisdiction. If the detainee "waives" extradition the process proceeds much more quickly.

Does a judge have the right to start your waiting period over again once you sign a waiver for extradition after being in jail for 30 days?

Probably. When you were jailed, the law automatically assumes that you will fight extradition and allows you that privilege, and the 'wanting' jurisdiction has to work on preparing legal arguments and proceedings to convince the holding jurisdiction that they have sufficient grounds to extradite you. . When you formally indicated that you would waive extradition, that introduced an entirely new scenario into the picture and the period began anew. Since you have now voluntarily 'waived' extradition your waiting period will probably not be much longer, trust me.

Your boyfriend is in Jail in California awaiting extradition to Texas after the 30 days are up can California release and rearrest him on the same warrant in Texas?

What makes you think there is a 30 day "Get Out of Jail Free" card? If your boyfriend refuses to waive extradition it will necessarily prolong the process between the two states. The states have to satisfy the legal procedures required to extradite the boyfriend which takes more time.

My boyfriend sign the extradition waiver in the first hearing but the court say the jail lost it so so they want him to sign it again what should he do he refuse. how long can they keep him in jail?

Not enough info. What state wants to extradite you? How long have you been held in CA? Did you waive extradition or are you fighting it? Also: What "expiration" are you referring to? I can find nothing that says there is only a certain limited time that you can be held.

What is the past tense of waive?
