According to Rule 6 of the Federal Rules of Criminal Procedure, a Grand Jury must have 16 to 23 members. According to Rule 23, a petit (trial) jury consists of 12 jurors, but there are a few exceptions that allow for a verdict from 11 or fewer.

The US Constitution does not specifically provide for a minimum number of jurors. The Supreme Court ruled in Williams v. Florida (1970) that the Sixth Amendment does not provide for a minimum number of jurors, striking down an appeal based on a 6-person jury, however held in Ballew v. Georgia (1978) that the constitutional minimum size for a jury hearing petty criminal offenses was six, striking down a verdict delivered by a jury of five.
