Senator Toomey has voted many times to obstruct the civil rights of gays and lesbians. He even voted in favor of an amendment to the United States Constitution which would have banned same-sex marriage. It is likely, then, that Senator Toomey would not favor the repeal of DOMA.

The Federal Convention (or Philadelphia or Consitutional Convention) started with 55 delgates from 12 states (Rhode Island often disengaged from national gatherings. Of those remaining at the end of the four month convention, 39 signed in favor and three voted against.

It wasn't up to Madison because he was one of many. The constitution is a compromise document and the men who wrote it did it as a group. The Bill of Rights had to be written and then voted on by the states.
