Notify your state's department of labor.
The labor department exists to help American workers out if there is ever a problem with their place of employment. If you get injured on the job and your boss refuses to do anything you would contact the labor department. If you do not get paid for your job and any other unfair thing related to your work, the labor department is who you contact.
File a complaint with the Department of Labor in your state. Just do a Google search for your state and the Department of Labor. It should bring up a website that will have the information that you need to file a complaint.

Yes it depends on contract if all workers are daily based then these workers don't need to be paid but if even in outsource this labor is paid then it will not reduce the direct labor much.
