What do you mean by "her spouse AND her husband. What kind of soap opera is this? No, you can only apply for your legal spouse (aka, husband). And by legal spouse or husband, I mean, the one you actually married by law. She filed a petition to bring her spouse (married legally in their home country) for permant visa but since she expects for this petition to take some time and since she is giving birth in the next 4 months can she petition her husband for visiting visa without compromising the permanent visa petition? In respone to the first answer, the spouse and husband are the same person, thank u in advance for answering.
To combat the wait, your spouse can file a Form I-129F - nonimmigrant K-3 Visa - at the same time that the immigrant petition is filed. This will allow them to live and work in the U.S. while your immigrant visa petition is pending. If your spouse does not file the petition for a K-3 Visa, they may be forced to wait outside the country until their application for immigrant status has been approved.
It depends on your nationality and where you have applied. No time is guaranteed. You have to wait until you are contacted by the embassy or consulate saying that your visa is ready.
H4 visa holders are not allowed to legally work. H4 is a derivative of an H1 visa. H4 visa holders are allowed entry to US because they are dependents of H1 visa holder. H4 visa holders are not eligible for Social Security Number. H4 visa holder may apply EAD only if filed concurrently with the principal's (H1 Visa holder) I-140 petition OR if principal's I-140 petition is pending or approved. You can't get legal permanent residency (and by extension- citizenship) through a student visa. The only was is through family petition, work/investment petition, or asylum.
How much time can go to Bermuda an there six moth visa from Jamaica
Quite a million dollar question with so many petition pending for approval. Depending on the availability, eligibility and preference the visa is issued. The time period for the whole process from petitioning, approval and visa issue can take anytime to even 10 years. So its always important under which category you apply for green card to lessen the wait time.
Yes they can. As long as that son is not married here or anywhere else. It should take 6 months to a year, (I think).
V visa is issued to those who are waiting to get their immigration visas approved. V-1 visa is for the spouse of a Legal permanent resident for whom an immigrant visa petition was filed with the USCIS on or before Dec 21, 2001. Also it has been three years since the filing of that petition.
It depends on if he is entering as a spouse or fiance. If you marry in Canada, he will have to reside in Canada until he can get a visa, which I have been told by Immigration is two to three years. If he entered as a fiance, then about 8 months after you get married, or longer. The actual length of time depends on how backlogged the immigration process is at the time you apply.
How much does a fiancée visa cost? The Form I-129F, Petition for Alien Fiancé(e) costs $340 to file. If your fiancée wants to work, filing Form I-765, Application for Employment Authorization will cost an additional $380.Source: immigrationamerica.org
