Was a new law passed in Jan 2004 saying that you can not refinance your home if it was listed for sale within 6 months of the application?

I have been a mortgage originator for over 10 years and I am not aware that any such law exists. Different lenders have their own criteria but most would allow a refinance if the property has recently been listed for sale. They would merely require proof that it is no longer on the market and a letter explaining why it was listed for sale and why you took it off the market. I am being TOLD that we cannot refinance our home if it has recently been on the market. I was wondering what mortgage comapny that you work for so I might get refinanced?

How many times can you refinance your home in a year?

YES you can refinance your mortgage if you have been living in the home for a year. The difference between a rate/term refinance and a cash-out refinance is simple. A rate/term refinance is when you refinance to try and get a lower rate if maybe your credit has improved or you lower your term from say a 30 year to a 15 year. A cash out refinance is doing a rate and term plus using the equity in your home (mortgage balance and any other liens on the property subracted from current market value of home) to pull cash out to consolidate bills or home improvements, etc.

Can you refinance a mobile home that is consider real property if it has never been titiled?

Can A Home Refinance Save You Cash?

Interest rates are lower than they have ever been. The time to refinance your mortgage has never been more ideal than it is right now. Getting a home refinance going will work for anyone with solid credit and enough paid on their home to make the numbers worthwhile. When looking at the cost of a home refinance plan, make sure you include any charges for early payment on your old mortgage and fees for getting it refinanced. If you see a significant amount of savings after these things are taken into account, the new home loan is probably a good choice for you.

If a bank refinances a first mortgage and there is a second mortgage on the property who does the first mortgage belong too?

The new bank in which the refinance mortgage loan has been taken from becomes the new owner of the first mortgage at the closing table. As for the second mortgage, the second mortgage holder remains the same. Before the first mortgage can close with the new lender, however, they must agree to re-subordinate the second mortgage along with their new one. It is not uncommon. I hope this information helps. Best of luck! Regards, Total Mortgage Services

Will a lender refinance a mortgage on a home that is listed for sale?

I do not know of a lender that will allow you to refinance a home that is actively listed for sale. There are several lenders that will allow a rate and term ( "No Cash Out" ) refinance the day after a home is removed from the MLS. There are a couple of lenders I work with that will allow a Cash-Out refinance the day after the home is removed from the MLS. Other important considerations that need addressed are * Is the home a primary residence / second home? * Is the property an investment property? * What is your intention for the property in the future? I frequently refinance homes that have just been taken off the active market. Please feel free to contact me if you have specific questions and I will be happy to assist you. If your mortgage arrears were included in Chapter 13 and when you refinanced you had to pay the arrears to the mortgage company and also to the trustee do you get this money back and if so how?

Your trustee is the only person who can advise you. However, it has been my experience (mortgage lending) that you must first obtain the trustee's permission to refinance and I believe the full amount is always due to the mortgage company.
