he will be turned over to INS after the completion of his prison sentence. They will hold him until a deportation hearing is heard. He will be scored with his felony and prior record then the judge will decide to deport or let stay. This can be a very long process because of the case load. What was the felony for? If it was violent he will most likely be deported. Have as many witnesses as possible for his character. And also be able to provide the referee judge with good family support, housing, and lined up work for him.

No. The marriage would not be allowed. Also, marrying a US citizen regardless of the circumstances does not prevent an illegal immigrant from being deported.

If an illegal Mexico immigrant was arrested for applying for a US passport under a false name and was deported using a different false name could he reenter the US on a fiancee visa with his real name?

No, when his fingerprints were checked his deportation history would be found. The foreign national committed a felony and therefore has been permanently deported. Any person attempting to circumvent immigration laws to aid a deported felon in returning to the US would be guilty of committing several federal felonies, all of which are punishable by a mandatory prison sentence and fines.

How would it be possible for someone to marry an illegal alien from Mexico who has been in trouble with the law and for this person to still be able to become legal and how long would it take?

If an illegal has been arrested for a felony ANYWHERE in the United States, he can be arrested and put in prison for 1 to 10 years for aggravated re-entry. After he serves his prison term he will be immediately deported and any time he is subsequently picked up even for spitting on the sidewalk, he will be put in prison again and subsequently deported. We already have far too many illegal aliens in this country. Don't encourage him.

If an illegal alien commits a felony crime will he be deported?

Not automatically. More likely you would first spend time in prison for the felony then if the government is so inclined they would deport you.Another View: The above answer is not necessarily true. The government may choose to simply deport you and save the taxpayers the cost of feeding and housing you for the term of your sentence.

Can a illegal immigrant gain legal status by marrying a felon?

An illegal immigrant would not gain legal status by marrying a felon because of a felon is not recognized as a citizen of his or her country and it is the same with the illegal immigrant he or she is not recognized as a legal immigrant. If such a union exist then there would be severe penaltiies for both couple,a deportation and even more years in prison An illegal immigrant would not gain legal status by marrying a felon because of a felon is not recognized as a citizen of his or her country and it is the same with the illegal immigrant he or she is not recognized as a legal immigrant. This would actually be illegal; if found out, you'd be deported and your "wife" might go to prison.

Will an illegal alien married to a us citizen be deported for driving under the influence?

Very possible. Being married to a US citizen has nothing to do with it if you haven't applied for citizenship. Driving under the influence has a lesser of a penalty than driving while intoxicated. Never the less, it is still a crime. If you do get deported, you will not be allowed back into the country and if you re-enter illegally, you will be convicted of felony re-entry after deportation and will spend time in a Federal prison. Another problem is how where you driving if you are illegal? Illegals can not legally possess a driver's license.
