Not automatically but the courts will usually file an order for paternity and if it isn't done the court may then file contempt charges then you have a chance to be jailed for that contempt choose your battles wisely .

Why is the mother automatically decided to be the custodial parent in pennsylvania?

Because we know she's the parent, we saw the baby come out of her. It's been documented. The father can be anyone until he has established paternity in court by leaving a DNA test. Then he can petition for visitation, custody and can pay child support.

Can a father legally add his name to a birth certificate?

You can put another man's name on the certificate, however if you are trying to collect child support from this man he has the option to prove that it is not his biological child with a DNA test. He however only has a limited window to have a test done, failure to take the test and prove that he isn't the father by default means he accepts the charge of being the father paying child support.

Who has legal custody of minor child in Colorado when parents have never married?

An unmarried father must establish his paternity and arrange for a custody hearing if he wants custody. Generally, if the parents are unmarried the mother has sole custody and control in most states until the father can establish his paternity. Remember, a child's mother can always be identified by medical records. Since the father didn't give birth and he was not legally married at the time of the birth he must establish his paternity by signing the birth certificate at the time of birth (waiving DNA testing rights) which must be done with mother's consent. If he doesn't sign the birth certificate then he must seek another way to establish his paternity and that is done through a DNA test. A paternity test can be arranged through the court. Once paternity has been established the father can request visitations, joint custody, full custody or the court will set up a schedule of regular child support payments for the child if she is to remain in the custody of her mother. The court will schedule a hearing and issue an order that is in the best interest of the child.

Do you need to get full custody if no paternity is established and you have no child support and have not had any contact for almost a year with him?

As long as you have not named this young man on the birth certificate of your child, then you have every right to continue to look after your daughter as a single parent. If you have named this young man on the birth certificate and he has decided to fight you for this child (or hasn't said a word yet) it is best you get sole custody and be sure the courts realize he has been an unsupportive father and has not paid child support. If he has been paying child support and neither of you have custody this could be a problem and he may fight you in court for his rights. After establishing paternity a biological father can petition the court for custodial or visitation privileges regardless if he has been placed on the birth certificate. The child support issue will only be addressed after such action has been implemented or if the birth mother files for support or public assistance.

If there are errors in paternity test results performed in the state of Georgia can they be made to issue a new test?

They can, but errors on a paternity test are extremely rare. A test might prove inconclusive due to contamination, but it would not incorrectly point to someone who's not the father. * Such a matter would be decided by the judge presiding over the case. Actually it is not unusual for a judge to reorder a paternity test if there have been previous problems with the testing facility.

Do Your Paternity Test From Home?

If only life were always so easy that paternity tests weren’t even something that we had to worry about. Unfortunately, they are. Circumstances can come up where a paternity test is an absolute must and you simply cannot wait to have one done. Once you have decided to have a paternity test there are different options that you can go with, but almost all paternity tests you need to see some sort of doctor and/or go to a medical lab. We all know with the rising cost of medical help how expensive that this can get, and insurance companies may not cover paternity testing. I’m happy to tell you today that if you are in this situation, you are desperate for a paternity test, but do not have the time and/or money, than there is a fantastic option for you. A company called GeneSys, which you can find at paternity-answers.com, has come up with a way to do your test from home, and send them the results, which they will interpret for you. Basically you start off by collecting the DNA of the father and child. This is much easier than it sounds, you just swab the inside of the right cheek and you have collected the DNA that you need. Once you have your samples you mail them in to the company for the data to be collected. That is all you need to do and you will have completed your portion of the paternity test. The cost to interpret the results is still a little pricy at $79.00, but you will have a turnaround in 3-5 business days and they will even email you the results, speeding up the time it takes to get your answer back. GeneSys offers an innovative new way for you to do your paternity testing without having to worry about bringing multiple people to the doctor, have them each do lab tests, and pay high medical expenses for both people. The test is easy to do from home, is only $79.00 and has a turnaround time of 3- 5 business days. If you do need a paternity test, don’t hesitate, go to www.paternity-answers.com and see for yourself today.

Why does essie Mae change her name to anne moody?

At the time of her graduation from the eighth grade, it was necessary to have a birth certificate to confirm her identity. Upon receipt of her birth certificate she discovered that her name was recorded as "Annie Mae" instead of "Essie Mae". With no time to request the correct recording before graduation she decided she would forever more go by the name on the birth certificate, shortening it to Anne. For True.
