Yet from what I know of law is that there is no guarantee of anything. Murder is Murder no matter what and there is now law written anywhere that says a person with a disability or other physical hinderment -cannot- be put to the death penalty. To answer your question. Being 72 and a diabetic with osteoporosis and hypertension will never guarantee a person of not being put to the death sentance. It may sway the jury out of recomending the death penalty. Yet, 6 counts of 1st degree murder is pretty extreme, and I personally doubt any jury would be swayed by any disability the defendant had. Even if the guy is given the death penalty by the courts, the prison will probably just lock him on death-row and let him go. He'll never see freedom again and quite frankly I don't think I would want him to. Most states won't get around to executing someone for being a serial murderer for several years and by then he will probably be dead already.
