Any driver over the qge of 18 is not considered to be a minor. Some states make provision in the law for the forcible drawing of a blood sample. Is yours one of them?

Your drivers license will be suspended.

You will be administrative suspended if you have a breath or blood alcohol level of blank or above or refuse to submit to a chemical test?

If you breath or have a blood alcohol level of .08 your license will be suspended.

How long will your driver's license be revoked for your first DUI conviction?

Depends on the state. In Florida a breath test over .08 with result in a 6 month suspension, a testing refusal would be 1 year. A second test over .08 is 1 year suspension, and a second refusal is 18 months and another misdemeanor for a 2nd or subsequent refusal. .

If a person refuses to submit to a chemical or physical test will their driving privilege be suspended?

Perhaps. Companies that employ drivers want to be certain that their employees are drug free. If you are drug free there is nothing to worry about, and it is in their right to request these tests at any time. After all you are driving something that does not belong to you.

If a driver is asked, should he/she take an alcohol breath test or not?

They should proceed and follow the policeman and his orders. If asked, a driver should comply with all requests by a police officer, including breath tests for alcohol. Refusal to do so is a violation of your driving privileges, and your driver's license will be automatically revoked.

If arrested for DUI or alcohol and instructed by the police officer to give a breath test what rights do you have?

While the answer varies by state law, the general answer is that you have the right to refuse but you will lose your license if you do refuse. In Oregon, for example, you are required to take a breath test. You do have the right to refuse, but if you do refuse your license is suspended for at least one year regardless of the outcome of the DUI charge.

California implied consent law?

Georgiaâ??s implied consent law says that if you are arrested for a DUI then you consent to taking a chemical test of your blood, breath, or urine for the purpose of determining your blood alcohol content. If you refuse then your license will be suspended for at least one year.

After a DUI how long does a restricted drivers license apply in Virginia?

A DUI leads to an immediate 7-day driver's license suspension in Virginia. There's an additional one-year driver's license suspension if one refuses to give a breath or blood test made mandatory on him/her. Its better to hire a professional in such circumstances. I'll chose 1800 DUI Laws for the job.
