The vehicle rolling backwards is the At Fault vehicle, in most cases.
We were taught in drivers ed to stay far back enough to see the bottom the the wheels of the car in front of you, incase this were to happen to us. If they rolled back a few feet it would be our fault, but if he was warned with the sound of your horn to stop, and still hit your car, then it would be his.
you are as if you were stopped, you should have had your handbrake on and if you were moving you souldn't have been so close, the cop is responsible for you damages though
If you are completely stopped, the person behind you will be at fault for BOTH cars since they didn't allow themselves enough time and space to stop safely.
If they wern't going backwards when you hit them you are at fault.
Depends. If you've stopped and they've crashed into you from behind, then no.
Yes. Yes, because it would be considered that you followed too close. Yes yes you would be considered at fault, being that you must ALWAYS be at a safe distance from other vehicles when behind. (at least 3 car lengths)
A stopped car shouldn't hit anything because it's not moving. If a car hits the car behind it must have been in reverse and front ended the vehicle. In that case the car that front ended the vehicle is at fault.
Under the "Following too closely" law the driver from behind is at fault.
it is ALLWAYS your fault for FOLOWING TOO CLOSE TO SAFELY STOP.
Hard to say. Possibly equal fault by both parties but most likely the person backing out.
the person who backed into youyou do not have to back up and if there is someone behind you and you back into them then it is your fault for hitting them and still the first guy's fault for hitting youas far as i know
NO, you are definetly not at fault. You saved a poor helpless animal. not being funny.
As a general rule, a parked or stopped vehicle is almost never at fault for an accident. The onus is on the driver of the moving vehicle to make sure the way is clear.
