If you are married to someone in theU.S.A and yet have not got a proper divorce you can not go to the U.K and return with a English husband , you could very well be arrested for begamy.
If you have a marriage certificate, that is your proof. If someone is contesting this, it is up to them to produce divorce documents. Even if you were in the process of getting a divorce at the husband's time of death, if there was no divorce decree, there was not yet a divorce.
If your husband is dating someone, you clearly have a problem to solve. Decide if you will stay married to someone who would do this to you. Insist it stops if you want to stay with him or file for divorce and find someone who deserves you.
If your husband was already married when you "married" him then your own marriage is null and void. In your case there is no need for a divorce because you are not legally married. You can be married to only one person at a time in the United States and all other Western countries. However, you should speak with an attorney. If he knowingly married you when he was already married he committed bigamy. The man may have committed other crimes if he conned you out of money or property. If your husband was already married when you "married" him then your own marriage is null and void. A divorce and a restraining order?
You must either have a finalized divorce from the person you are already married to, or risk being charged with bigamy (and most likely convicted).
Obviously you don't really want to stay with your husband; why are you dating someone else, then? You have already stated he is abusive and you know someone who is able to take far better care of you. Accept the fact that your hussband is, for lack of better terms, a dangerous and unloving person. Divorce him and pursue the relationship with the other man, provided he is not married himself and would be accepting of the idea.

No she cannot get a scriptural divorce after she has already taken back her husband. They are "one flesh" again so if she gets a legal divorce and marries someone else, she commits adultery. If she wanted a scriptural divorce, she could've divorced him after he committed adultery and not "forgiven" him and taken him back.
If you're in the US, a judge will not force someone to stay married to you if they don't want to be married to you, so basically, yes...the court can and will grant a divorce rather you're in agreement with it or not.
If you are married, they can apply for a divorce.
Yes, it is injust to keep someone who doesn't want to be married with someone they don't love.
