If you don't go to court you'll have little chance of getting any help.

If you do, and tell the judge you have a payment plan you think can work, he would be very likely to adopt it.

Obviously, if the creditor has a judgment against you and it can be collected at one time they most likely would prefer and try to do so...but if they have to collect over time (say by garnishing wages over years), they would just have to do that. Any costs to collect become your obligation too.

What type of legal action can be taken if your car is reposed?

If the creditor and repo agency did their thing by the book, you really have no legal recourse. As long as the creditor holds the lien on the vehicle, it belongs to them, and they have a legal and binding right to reclaim it when you fail to make your payments. Besides, if you tried taking legal action, the judge would probably chastize you for your inability to make your payments in spite of being able to afford a lawyer, then throw the case out.

How will the credit card debt be divided between the husband and wife during a divorce when the debt is only in the wife's name?

It is up to the judge to determine who is responsible for repaying the debt owed on that credit card account. Unfortunately for the cardholder, if the husband is required by the court to repay the card, the wife is still responsible for ensuring that those payments are made. If he misses payments, then her credit score will suffer.

Massachusetts laws regarding credit card debt of a spouse?

In Massachusetts: Generally, a judge can assign a credit card debt to the other spouse in a divorce proceeding if the circumstances warrant such a redistribution. A creditor must make a claim within a statutory period against the estate of a deceased debtor. If an estate has not been filed in probate court a creditor may petition to administer the estate. The credit card company cannot make the decedent's relatives pay a debt that's only in the decedent's name.

What if your out on worker's comp unable to pay your bill's you try to make payment agreement creditor says it's not acceptable can they sue you or can a collection agency who brought the debt sue you?

First, collection agencies do not typically buy debts. They recover them under contract for the original creditor. Second, regardless of your ability or lack of to pay, the debt is still owed. By law, the creditor need not accept anything less than the amount owed or balance in full. Third, keep all records of payments made to all creditors including mortgage and utilities and basic living needs, plus all income received, and when you receive the service to appear in court, show up and present this all to the judge. He will not likely forgive the debt, but he will order payment arrangements based on what you bring, especially if you have in writing any refusal to accept payments, and this will reflect poorly on the original creditor.
