Depends on your contract. Get it out and read it. Some have an "as is" clause and that means you bought as it was leaks and all. It may have a 60 day return in the contract so you could return it. If the dealer or person you bought it from is honest he or she may fix it or allow you to return it.

These are common for oil pan gaskets, if the oil level is a quart low it most likely isn't high enough to leak out the gasket
You'll have to get under there and look for the leak. It could be either one.
"Mechanic in a can" get some engine clean, diesel, or some trans fluid; drain a quart of oil out of the engine; then put a quart of what ever you got in to the engine replacing the oil you just drained; run it till it's warm, drain it all out and change the oil and filter; start it up check for leaks and see if your noise is gone; repeat if nessesary; do not drive around for 3000 miles. you can try this with marval mystery oil too.
