It depends on the exemptions. If you have to use your state exemptions, you will have to ask a local bankruptcy lawyer.

If you can use the federal exemptions, you are able to exempt up to $2,025 in work-related property. You may also apply other exemptions, such as the motor vehicle exemption, the wildcard exemption and half of the unused portion of the homestead exemption.

To file chapter 11 bankruptcy one must propose a plan and then must find creditors to agree with this plan. Can your husband file bankruptcy if you filed chapter 7 two years before you were married?

Yes. Married people can file individually. The marriage actually has nothing to do with it though. If you filed, no matter what, you can't file chapter 7 again for 8 years, provided you received a discharge. He can file anytime he wants. If you have any joint debt, you may want to consider Chapter 13. Take a look at it. You can file a chapter 13, just not a chapter 7.

If you filed bankruptcy and one of the creditors had a lien on a car do you get the title back after the bankruptcy is final?

It really depends on the type of bankruptcy petition you file. If you file for Chapter 7 bankruptcy the creditor who put the lien on your car may be able to take your vehicle. If you file for Chapter 13 bankruptcy you'll have the opportunity to make payment arrangements with your creditor and in that case you should get the title back after all of your payments are made and your amended. contract with the creditor has been fulfilled.

What is the means test to file bankruptcy?

One of the first steps you must take when filing for bankruptcy is to complete a "means" test. You must submit the results of this means test to the Bankruptcy Court. The means test checks your income in order to determine your eligibility to file for bankruptcy. If your income is below the average for your state, then you can file for Chapter 7 bankruptcy without any problems. However, if your income is above the state average, the calculations for the means test become more complex. The means test looks at your disposable income (the amount left over after paying your expenses). If your disposable income is too high, the Bankruptcy court may decide that you can pay off at least some of your debts, and prevent you from filing for Chapter 7 bankruptcy. You are still able to file Chapter 13 bankruptcy, however.
