What you're talking about is in legal terms called "Adverse Possession" and yes, it's technically possible to do so. Generally speaking, if you occupy the property for long enough, the lawful owner is considered to have relinquished title to you. However, there are a lot of conditions that have to be met, and you'd really need to consult a local lawyer for details (one recent successful case of adverse possession in the US involved a judge, who knew exactly what steps he needed to take to satisfy the legal requirements).

Changing apartments is the same as moving from one place to another. There are cleaning and painting that takes place. There is no reason they can't charge the same as if there was a new tenant moving in.
