Yes. It is always legal for a cat to kill a mouse. Laws in general cannot be made to apply to animals because animals can't understand them.
The cat's owner may be subject to civil law if the mouse is a valued pet. the mouse's owner could bring suit, one supposes.
If the mouse is a wild mouse living in the walls of the apartment, the apartment landlord could, perhaps, be sued for allowing an infestation of mice; the cat killing the mouse would be legal, but the apartment owner might be breaking the law by not maintaining his apartment in a safe and sanitary state.
