The welfare of the child should be the main issue. The best parent or maybe both paremts should have custody. Who is to say that one parent is better than the other with out prove of child abuse. During custody battles, the parents are so wrapped up in themselves that the children are not actually considered. the mother has sole custody if she is not married, a father has many more rights if the child has his last name, or if he is named on the birth certificate. However, if an unmarried mother has a child who has the father's last name and she gets the child taken from her by the state, the father would actually have to file a custody petition in order to try and get custody. Nothing is automaticly in his favor there.

It could complicate things terrifically. We would give serious thought to skipping it. He doesn't sound like a guy who would be really good at child support or parenting, so...He should still get supervised visitation with random testing. I k now this to be true, because my son and his ex got a divorce and asked for shared custody. The final decree gave his primary custody and her the every-two- weeks, etc., she would have gotten in any case. They shared because he wanted to. My granddaughter thought it would work for her, too, but her ex didn't stick to the plan once he got prime custody and she only sees her son when the papers allow her to.

This is my thought son the question. I believe that the court ordered visitation should be an excused absence from school seeing that if the custodial parent does not OBEY the court order it is then considered Contempt of Court, so....Yes if it is court ordered a child should be excused from school for a visitation.

He has no legal right to be with/see/have contact with the mother of his child if her parents--or his (since he's also a minor)--are opposed to it. Once paternity is established he has the obligation of paying child support and the legal right to petition for court-ordered visitation with the child, but that is only for visitation with the child, not the mother of the child. well i think its there choice to be honest so just leave them alone and dont talk about them behind there back, ok?
