Not right away. The local authorities will start an investigation. You may be taken into custody and held until a formal hearing takes place. You may be fined and / or sentenced to serve time in jail, and then finally deported back to America. Usually a short violation period of a week or so, is treated as a minor offense, but 3 weeks is very serious.
He was illegally in the country, so he knew the authorities could deport him. It was not his fault that there was a delay in getting his documentation processed, so he could not believe it when they said they were going to deport him.
Best bet is to renew your paper work first. If you waited to long and you could not do that then you would have to wait. Wait until your paper work is in order. I mean you can try, but someone is going to ask if you have your card and they will run your name.. and WILL deport you. First experience, I know.. Hope I helped
