Yes. Failure to reaffirm means that you cannot be sued to recover a deficiency. You can still make the payments.

Which mortgage protection service or company covers payments if you were dismissed in your job?

none

If you did not get your mortgage reaffirmed does this mean you will lose your property?

From my understanding after filing Chapter 7, our house was not reaffirmed, but the mortgage company clearly states that as long as the payments are kept up they will not take action against the house and if they do, their interest is solely in the house, not contents.

Mortgage foreclosure dismissed for want of prosecution?

The mortgage company did not go to their own court date and the foreclosure was dismissed. They will be able to refile it if it was without prejudice.

No.

If a loan is not reaffirmed in bankruptcy but you continue to voluntarily make payments can the loan company report you to the credit bureau if you're late with these payments?

According to my mortgage company, "no." However, the bad part is that you continue to accrue late charges and in the event you accidentally missed a payment, they don't make the standard courtesy calls. They cannot pursue the money once the BK is complete.

If the mortgage was reaffirmed but on your credit report it appears as Bankruptcy is this an error?

Yes, a reaffirmed mortgage needs to reflect the mortgage payment history before, during and after the bankruptcy proceedings. "In Bankruptcy" needs to portray only DISCHARGED BY or INCLUDED IN...Bankruptcy. Contact your mortgage company so that all of your payment history shows on all three bureaus. No. Not if it were a part of the bankruptcy filing. It may or may not be marked included in bankruptcy or reaffirmed in bankrutpcy. It will still remain on the CR for the prescribed time.

My mother passed away I have siblings and no one has reported her death to the mortgage company we can't afford the house payments is it the law that you have to report it to the mortgage company?

No, once the mortgage company begins the foreclosure process they will find out that your mother is dead. This will not stop the foreclosure process. The only way to avoid that is to make the payments.

If you are in Chater 13 and behind on two mortgage payments and now the mortgage company filed papers in bankruptcy court is it too late to pay?

Not necessarily. You need to contact the trustee of your chapt.13 and the mortgage lender. Foreclosures almost always end up as a loss to the lender. If you can make up the back payments and convince the lender that you can continue to make payments on time, they will probably be cooperative. However, the trustee also has a say in the issue, and can opt to have the 13 dismissed. Stay positive, and good luck!
