Regardless of the state, if you are not at-fault in an accident, you do not have to have your vehicle repaired, you can simply accept a check. Be careful though, because if you are involved in another accident the next company will not offer you such a large payment. The insurance company has an obligation to restore you to pre-loss condition and if you have existing damage on your vehicle they will not pay for that resulting in a lower payment in the future.

Depends on who was at fault: If you were at fault, then you would get a citation (TICKET) for driving without a license (See 12500(a)C.V.C.- an infraction) and would also be cited for the violation that occurred leading to the car accident (i.e., illegal turn, fail to stop at stop sign/signal, etc....) If you weren't at fault, the other person would be cited. Just because you don't have a license doesn't automatically mean you're at fault. If you're an out-of-state driver with a valid license, then you'd be treated as if you had a valid California license.
The license status of the other driver has no bearing on your liability. If you were at fault you are still responsible for any damages and injuries. Just report it to your insurance company as you would any other accident.
I don't know, but if the accident was your fault, why should he have to pay it? Might be better to pay it so you can keep your job (if the accident was your fault). Probably not, if you were on company business at the time. If you take a company truck home after work and you were at fault, that's a different situation. No. Just the fact of being unlicensed does not mean that the driver did something that caused the accident. Being unlicensed is what is called a non-moving violation. Another violation of this type may be not having a current registration tag on the vehicle. Just because you don't have a tag on your car doesn't automatically make you at fault for someone hitting your car. Fault for the accident will have to be determined by the police officers after they investigate the scene and take statements from witnesses. The person who is driving without a drivers license will get a ticket for not being licensed and then whoever was at fault will receive a violation for whatever they did to cause the accident.
If the accident was your fault and your company doesn't have an accident forgiveness policy or you haven't been with your company long enough to qualify for forgiveness then I would highly consider paying out of pocket for the damage. If the accident wasn't your fault then go ahead with the claim. Make sure that you know whether the accident is your fault or not. What an insurance company thinks about fault is often times different than what you think.
