You have to be 18.
A 13 year old can make a decision regarding who to live with if her mom dies and her dad is mentally disabled. She will need to petition the family courts to make a legal declaration.
yea shes already 16 geez
No, not without a court order. In every state in the US, the child must reach the age of majority in the state where they reside (18 to 21 depending on the state) before they can make legally make that decision without approval of the court.
The courts can make the decision to place a 13 year older in the right living situation that will better benefit their well-being. All the child needs to do is get the help of another older family member. It should be an easy process if the mom dies and the mentally-ill dad does not have custody.
Your dad is still your dad and you should respect his wishes, but technically, your mom is your legal parental guardian and she can say yes or no and you make your decision. dont know
this is just more information cause they would not let me put this all in here okay i am 15 years old and live in CT with my brother dad and sister... my aunt lives in Ohio and her lifestyle and her friends and family's out there is one that i wanna live its a fun, religious, and kind of old school and she said i can go out and move in with her and i really want to i believe that it will be an extremely great decision the will effect my life in a great way... but i haven't asked my dad yet i need some advice on what to say and how to say it it will be greatly appreciated
no, not until legally 16 or 17.
If your mom has legal custody of you, then no, you can't go live with your dad without your mom's consent. If your dad wants custody he will have to petition the court for custody of you, which would require him hiring an attorney. As for you making your own decision as to which parent you prefer to live with, the judge will possibly ask you which parent you want to live with and why, and then may use your preference in making his determination, but it won't guarantee that you will still get to live with your dad.
Probate court will make the decision since there is no will.
where does my dad live
If she is the beneficiary, then she must make that decision.
Sorry, you cannot make your Mum or your Dad buy a cat if that is not what they want, even if you plead this is still not going to help your cause. If your parents have said no then please accept their decision.
