The IPC 498a is Dowry Act.

P.S. - But, wives along with her parents and siblings (sometimes her boy friend also), low police officers, and worst of all judges misuse Dowry Act as a Marriage Act. Initially, under Dowry Act husband and his relatives are immediately arrested and jailed thereafter in the court of law Dowry Act is converted unofficially and unfaithfully into Marriage Act to further harrass them stringently for several years.

Why did people settle in Miami florda?

Most Cubans have migrated to Miami to get away from Fidel Castro's communist regime in Cuba. An exerpt from the Imigration Policy Brief states that " In 1959, after Fidel Castro seized power in Cuba, thousands of Cubans, including a number with connections to the Batista regime, left the island, primarily via regular means of travel (i.e., scheduled flights). As many as 78,000 arrived in the United States in 1962. In October of that year, Castro halted regular travel between Cuba and America. Except for the period from 1965 to 1973 - during which the Cuban government allowed flights to Miami that permitted approximately 50,000 Cubans to come to America - Cubans seeking to escape the Castro regime have been forced to pursue more dangerous routes into the United States. In the 1960s and 1970s, the Attorney General's authority was used to grant special permission (called "parole") to allow Cubans to enter the country. However, parole only allows an individual permission to enter the country, not to stay permanently. In the case of Cubans, this dilemma was resolved by the Cuban Adjustment Act of 1966. As amended, that Act provides that the immigration status of any Cuban who arrived since 1959 and has been physically present in the United States for at least a year "may be adjusted by the Attorney General…to that of an alien lawfully admitted for permanent residence" (green card holder). The individual must be admissible to the United States (i.e., not disqualified on criminal or other grounds)." Then in 1980, with the Mariel Boatlift, 125,000 or more Cubans left the island in boats headed for Miami over a seven-month period, facing no prospects of leaving Cuba by normal means and seeing no possibility of the regime changing or their families' human rights and economic futures improving. Why 498 is misused?

The anti-dowry law (498A), was enacted to protect women from dowry harassment and to deliver justice to the true victims. Unfortunately unscrupulous women are misusing this law as a legal extortion weapon to victimize families legally. Just a single written complaint by a woman, irrespective of its authenticity, is enough to arrest the husband and in-laws and whoever she has named in her complaint. The innocent families are presumed guilty and are brutally threatened by the protectors of law and forced to settle the case by paying the woman demands, which are exorbitantly large and may also include ancestral property. Very often, such cases continue in the courts for years, which prolong the suffering of the innocent families. Though projected to be a law benefiting women, 498a has, ironically, victimized countless innocent women related to the husband's family. Thousands of such false 498a cases are filed each year and innocent families are legally terrorized. A large number of cases filed under anti-dowry law IPC 498A are not cases of actual dowry demands, but a reflection of a more sinister design to legally blackmail innocent husband and in-laws for money. The statistics prove that more than 90% of the dowry cases filed are false (validated and independently confirmed by the Council of Social Research). Supreme Court has termed such malpractice as "Legal Terrorism." High Court has categorically ordered to do something to stop such misuse. World Health Organization has expressed grave concern over the way old parents are legally abused by their daughter-in-law misusing 498A. The situation is so serious that even the foreign governments have taken note of it. The US Govt. has issued a warning about the misuse of the dowry law on one of its official websites. The Canadian Govt. has also issued similar advisories.

Is there any section in the ipc to protect the marriage of a Hindu man to a Muslim woman?

It would probably be unusual for the Indian Penal Code to apply to a marriage, but India's Special Marriage Act of 1954 allows for the marriage of Hindus and Muslims. Marriages performed under this Act have the protection of law, regardless of cultural issues or the claims either religion may otherwise seek to make on the validity of such a marriage.

What is the Dowry System in India?

In India dowry (known as Dahej in Hindi) is the payment in cash or some kind of gifts given to bridegroom's family along with the bride. Generally they include cash, jewellery, electrical appliances, furniture, bedding, crockery, utensils and other household items that help the newly-wed set up her home. In Hindu marital rites it is called Kanyadaan, where 'Kanya' means the daughter and 'daan' means gift. In India the dowry system has been putting great financial burden on the daughter's family. It has been one of the reasons for families and women in India resorting to sex selection favoring to have a son. This has distorted the sex ratio in India (933 females per thousand males)and has given rise to female foeticide. The payment of a dowry has been prohibited under The 1961 Dowry Prohibition Act in Indian civil law and subsequently by Sections 304B and 498a of theIndian Penal Code (IPC). Despite the anti-dowry law in India, it is still widely and illegally practiced across the country.

Please explain difference between 34 IPC 149 IPC AND 120B IPC with example?

Section 34 of the Indian Penal Code provides for the liability of a criminal act done by several persons in furtherance of a common intention. Section 149 deals with the liability of members of an unlawful assembly for an offence committed in prosecution of the common object. Section 120B deals with criminal conspiracy, where two or more persons agree to commit an illegal act. For example, if five people plan and execute a robbery together, they may be charged under Section 34 IPC. If a group of people gather to attack someone and one of them kills the victim, all may be charged under Section 149 IPC. And if two persons conspire to commit a robbery, they may be charged under Section 120B IPC.
