Food is biodegradable and will become part of soil unlike plastics that will never degarde on their own. Whether or not it is trash is in the eye of the beholder. Banana peels can be benefical to gardens, but your neighbors or strangers that have them thrown in their yard may not approve of it because it is 'unsightly'. Also if it's getting thrown is someone else yard they may be concerned about tripping on it. I can't say as to what the police would say if they caught you throwing one out your car window, but I don't think they would approve because roadways are meant to be kept clear. My suggestion is to throw them in your yard or garden and keep nature's goodness to yourself.
ClarificationThe answer is yes. If you throw it out of your car window or on the ground on public property you will be cited for littering. Just because a discard is biodegradable that doesn't mean it's okay to throw it on the ground. If everyone did that the world would be a smelly, messy place indeed.
