The real factors are how aggressive the prosecutor chooses to be in such cases, especially if it happens to be an election year (seriously), or the person has prior criminal convictions, or even complaints on file for any type of sexual misconduct or other offenses relating to minors. Another issue taken into consideration is if the accused is/was a person of authority over the minor, such as a coach, teacher, counselor, an adult living in the same household and so forth.
