Yes, and you can own one in any state, although some states have certain restrictions. For example, New York, New Jersey, Massachusettes, Connecticut, and Cook County, Illinois have the 1994 Clinton ban written into their legislature, so AR rifles sold there may only have none or one of the features listed in the ban (flash suppressor, pronounced pistol grip, telescoping buttstock, etc.). In California, rifles not registered prior to the 2000 registration of so-called "assault rifles" must either be featureless (in addition to the features listed in the Clinton ban, California also includes forward grips in theirs), or else must have the "bullet button" installed, which makes it technically a fixed magazine rifle. Additionally, the lower receiver must not be from a manufacturer listed by the California DOJ.

There is no legal definition of "assault rifle". If you mean an AR15 style rifle, then it depends on the rifle, and what you are hunting. An AR15 firing .223/ 5.56mm can be used for small game. For big game, the rifle may not be capable of holding more than 6 rds of ammo, and must be .24 caliber or larger, with 1000 ft lbs of energy at 100 yards. The AR15 in .223 will not meet those standards. A larger AR, such as the AR10, could meet them. No fully automatic firearms may be used for hunting.
