The ATF does not consider air rifles firearms, but you must check with your municipality/county for clarification. For example, my municipality (medium sized midwest city) considers any kind of device capable of firing a projectile a firearm. That would include air rifles and even airsoft guns. I know for a fact that local P.D. has issued summons' for people shooting airsoft guns in the city.

Only if the scope is designed for air rifles. Regular firearm scopes are made different than air rifle scopes and many will break if used on an air rifle because the recoil is different than a firearm.
