It depends on the law where you live and your custody order. If the father has sole legal custody (as opposed to physical custody) he would be able to make that decision without input from the mother. If legal custody is joint or the mother has sole legal custody, no he could not.
Who is in jail? If the child is in jail, they have custody. If the adult is in jail, they should never get custody. If the spouse is in jail they should not get custody. Jail would have no bearing on the time of custody, just who should be able to even see the child.
Just like anyone else who isn't the biological parent she would have to go through the courts and prove she is able to take care of the child better then anyone else and since she isn't really related she will have to prove that there is a strong bond between her and the child
You probably can, if you get the paperwork and permission then yes, I'm sure you can. Also , make sure you are at a legal age to be able to take custody over someone.

* Unless your fiance sprung the fact he had a daughter on you at the last minute then you should be able to handle this. If he didn't tell you about having a daughter then he probably was fearful you wouldn't be able to handle this information. You did not state if the mother has custody; he has full custody or it's joint custody. If you love him it shouldn't make a difference. One day you will have children of your own.
You haven't mentioned who has legal custody. You can go and just get them if he doesn't have legal custody. You should give him and the children some time to prepare for the move so as to cause the least disruption for them. If he has legal custody you need to petition the court to modify the custody order now that you are able to provide for the children yourself.
