For purposes of discussion and to avoid a lot of awkward phrasing, let's label the parties involved: A and B are married. A wants a divorce in order to marry C. B is contesting the divorce.

  • B cannot actually stop A from getting engaged to C. Legally speaking, engagement is a form of contract, and like any other contract it can be subject to conditions. For A to tell C "As soon as my divorce is final, I'll marry you" is perfectly legal (if not particularly bright... see below).
  • B can try to use A's engagement in the divorce proceedings as leverage to obtain more favorable terms in the settlement.
  • C can at least theoretically sue A for breach of contract if A ends up reconciling with B. This is especially true if A told C the divorce was already final, or if A concealed the marriage from C entirely.
