It is assault.

You can also be sued (in Civil Court) for unlimited funds if you give the person you spit on ANY reason to suspect you may have a communicable disease, since that may put them "in fear for their life". You should also be aware that if someone genuinely DOES "fear for their life" as a consequence of being spat upon, in most communities they can KILL you and not be found guilty of murder! It's also just plain gross and disrespectful.

You could be charged with disorderly conduct, or even with assault, depending on the circumstances. In any event, yes, you can get in trouble for spitting on someone. I read about one case where a person with AIDS was conviced of attempted murder for spitting in someone's eyes.

The answer depends on where you live. Yes it is. It's called assault around where I live and people have been arrested for it. I worked in a convenience store once and a customer became abusive. He spit on one of my co-workers. The cops arrested him for assault and he actually was convicted.

Yes - if you did it deliberately, it is assault. If it was an accident, it is not a criminal offence but it is still tortious (you can be sued).
