That would be a judgement of the State Bar Association.

If the divorce is going to be uncontested and both parties mutually consent to it, it is not unlawful to retain the same attorney to prepare their paperwork for submission to the court.

In Arizona are you required to have a separate attorney for divorce proccedings?

You are not required to use the services of an attorney to obtain a divorce in Arizona. However, a single attorney is prohibited from representing both spouses in the same divorce matter due to ethical conflicts of interest that are likely to arise. The only exception to this general rule applies when an individual attorney is acting as a mediator in assisting the two spouses in settling their disputes, in which case that individual mediator/attorney would not be allowed to draft the Divorce Decree or related settlement documents.

What is the ethical violations of an attorney consulting both parties in a divorce?

conflict of interest! one attorney cannot represent both parties, you are suppose to be able to trust your attorney with any confidential information and they are suppose to represent you in your best interest. i don't see how they can be impartial working both sides. i would make sure if it was myself i would have my own attorney who will work just for me! Added: Please define your understanding of "consulting." The attorney for one party MAY "consult" with the other party with a view towards settling certain items, either amicably or without the necessity of fighting them out in court. HOWEVER - the same attorney may not represent both parties - nor would the court allow it.
