It's not illegal, but some Sydney Santas do say "Ha Ha Ha" instead so they don't scare children.

In November 2007, Sydney recruitment firm Westaff advised their 30 Santas-in-training to say "Ha Ha Ha" instead of "Ho Ho Ho" because it was thought that the traditional "Ho Ho Ho" could frighten children.

The US media published the story saying that the firm opted against "Ho, Ho, Ho" for political correctness ("hoe" is a US slang term for prostitute). However, the firm denied that claim, saying that they were simply training Santas to be sensitive to children's fears.
