Yes, because she is a minor it would be considered kidnapping.
Response :
I posted the question, and we have already contacted the police and they are looking into the code, but evidently it is NOT considered kidnapping because it was not against her will. I don't understand how it is illegal for a non-custodial parent to take his OWN child across state lines without the custodial parents consent, but a guy can take MY child across state lines without my consent? There is something wrong here......
It would depend on the state or country. In the US taking a sixteen year old on holiday (across state lines) May be illegal. The age for sexual consent is usually 16, but taking a 16 year old without the parents consent may be kidnapping.
Transporting a Minor across State lines is a Federal Felony Crime no matter what the reason. Typically a minor requires parental consent to get married. Without it, the marriage will not be legal. There are a few places that would allow a the marriage with a court order, but not likely to be issued if the parents do not consent.
Please help me with this before our 18 year old granddaughter takes her 17 year old boyfriend to visit in N. Carolina. We are from Oregon.
Harboring a runaway in California without the parent's consent is illegal and can result in criminal charges. Additionally, taking the runaway across state lines without permission could also violate federal laws, such as the Unlawful Flight to Avoid Prosecution statute. It is important to contact the authorities and the runaway's parents to ensure their safety and legal compliance.
A mother cannot move a child across the country without a father's consent. However, if it is spelled out in separation or divorce papers, she can.
No. You must be at least 18 to get married without parental consent. Some jurisdictions will issue a court order if the parents cannot be located. The transporting of a minor across state lines without the consent of the parents or legal guardian is a federal felony. If the act is committed with the intent of having sexual relations with said minor it carries a mandatory federal prison sentence.
Yes, it is illegal, and not just in Mississippi, either ... same is true for most states. could someone expound on this scenario, I had a private conversation with an adult student, in my office and she recorded the conversation without my consent. THEN my supervisors said they deemed it legal for them to listen to it. ALL of this without my knowledge until after the fact. I felt raped. Even though they "determined" nothing incrimination or letigenous, It is the fact that students now feel they can record our private conversations and others hear them without my knowledge nor the knowldege of the issue surrounding that case,, Are they scamming me? is this illegal?
No you cannot. That would be classified as kidnapping across state lines in the event the parents decided to go after you for it which is a federal offense.
Yes, a minor in Michigan is subject to their parents and they could report a runaway and kidnapping.
To get pierced legally without parent consent you have to be 18 in the United States.
That's called kidnapping. You will need written consent from the parents, probably notarized. Check with a lawyer or a travel agent.
Across state lines? To which state? There are no states that allows a 16yo get married without parental consent.
