Absolutely not! You are legally bound to discipline your child, not abuse them.

how is a smack on the bottom abuse! abuse is when you actually use violence etc a smack is a correction procedure me and my brothers were smacked as children if we were naughty and my kids get the same if they are naughty aswell.

In New York the law reads

§ 35.10 Justification; use of physical force generally.

The use of physical force upon another person which would otherwise

constitute an offense is justifiable and not criminal under any of the

following circumstances:

1. A parent, guardian or other person entrusted with the care and

supervision of a person under the age of twenty-one or an incompetent

person, and a teacher or other person entrusted with the care and

supervision of a person under the age of twenty-one for a special

purpose, may use physical force, but not deadly physical force, upon

such person when and to the extent that he reasonably believes it

necessary to maintain discipline or to promote the welfare of such

person.

You shouldn't be slapping your child's face anywhere!

Another View: The question is MUCH TOO GENERAL to be answered with a specific yes or no answer.

(1) What are the prevailing circumstances?

(2) How old is the "child?"

(3) There is slapping, and then there is "slapping."

You could well be prosecuted if you repeatedly struck a child with the distinct possibility of causing physical harm.

HOWEVER - the laws intent is not to restrict or deny the parents prerogative or authority to discipline their offspring, either. Slapping a "potty-mouthed" 6-year old for a nasty remark in the supermarket may not be pleasant to see, but it must be left up to the parent to decide when, and under what circumstances, the discipline is applied.

On the other hand; if the parent is seen to be losing control, or clearly becomes abusive toward the child, THEN the law can be called in.

While it is not per say illegal it is definitely not advisable. Some police officers or child protective workers or school officials or juvenile courts may define this as abuse and attempt to remove the child or put a safety plan into place in your home (which constitutes routine involvement of the state to monitor and supervise your home with or without removal of the teenager). If the child would contact the police or CPS directly you could be arrested for child abuse.
While no one can guarantee you will not get into trouble if this was a one time incident you would probably be okay. For example my teenager called me an "effing wh$$e" said without the abbreviations, I IMMEDIATELY slapped him across the face. The police did become involved and I was cleared immediately upon my teen admitting the deragatory comment he had said to me. They could have however sent me to parenting or anger management classes but my teen was very clear that in his entire life this was the ONLY time that I had slapped him in the face. Thank God that police officer had a teenager and understood the situation. You must remember that the police have wide discretion in contacting CPS or arresting you for abuse.

Is it illegal for a non custodial parent to take a 15 year old for a tattoo without permission from custodial parent?

Yes, if the state require consent from the legal guardian since the non-custodial parent is not the legal guardian. And yes, because the non-custoduial parent does not have the legal right to make that kind of decision for the child. The non-custodial parent could face sanctions from the court. The custodial parent could sue to have the non-custodial parent pay to have the tattoo removed.
