Not only is it illegal, its dangerous. If it comes loose while your driving and it hurts someone, you are responsible, even more so because you are aware that you have it in that condition. Just correct the problem, before the issue arises. Computers are also very savvy technology, there also is a way to track your entry in the subject should law enforcement decide to trace the question and make you liable on both knowing you had a faulty spare wheel and failing to correct the problem. fix it before its too late.
