In many states, yes. Just because eBay lets you do it, doesnt make it legal where the tickets are going to be used.

What is the value of four unused tickets to Yankee Stadium for games during the 1994 strike includes parking and stadium club passes?

In general tickets from the 1990's to the present have a collectors value of about $3.00 - $5.00 each. What gives the tickets value would be baseball games that features a special event or a player milestone. Special events such as opening day, inaugural games, last game at a Stadium, play-offs, World Series, etc.Player milestones can include 500th home run hit by a player, and the home run games that lead up to the 500th home run. 300th win game by a pitcher, 3,000 hits, or any record breaking event will add value. The tickets you have are from the year the players went out on strike. Although this is an historic event, there is no demand for the ticket to games not played. The tickets might fall into the "phantom ticket" category, and have more of a novelty price than a collectors value.A Phantom Ticket is a ticket that is produced in anticipation of a team making the playoffs, or World Series but not used when the team failed to make it. In this case the tickets were printed for the regular season, but with the strike, the games were never played. There is a small market for World Series phantom tickets, but they have a low value, and do sell at more of a "novelty price"It could be a long time before the "regular season strike phantom tickets" have a significant collectors value.

Is scalping tickets illegal?

Yes but people found the initial loop hole. Everyone now says "I need tickets" which is code word for I have tickets. Little sneaky way of not attracting cop attention but still getting the job done. At our stadium they allow scalpers to sell tickets outside of the gates but they can not sell them more than face value. If they are caught high capping then thats when trouble reigns down. Scalping laws depend on the state though some have anti laws and some embrace the free market. Everyone online "scalps" because they sell their tickets for way more than face value. Since the internet is borderless, it's hard to decipher what laws apply where so everyone gets away with it. Kind of like downloading music it's illegal but everyone does it.
